Just send them a brief letter denying that you were there for the period stated and then forget about it. Don’t waste money on a solicitor.

For the record, if they’ve described it as a ‘penalty’ then they can’t charge it anyway, whether you were there or not.

Yes. The warden’s quite right to issue a ticket if they don’t see any evidence of loading or unloading in a reasonable time, normally 10-20 minutes depending on the area, but that doesn’t mean the ticket’s valid. All you need to do is prove that you were making a delivery and that you were only in the loading bay for the time it took you to complete the delivery. 3 piece suites don’t carry themselves into buildings while you wait by the van doors.

As long as there are no unloading restrictions you get as long as you reasonably need to actually unload. You may get a ticket after 10, 15 or 20 minutes (depending on the rules in the area) but the ticket will only be valid if you can’t show that you were unloading. Unloading includes the act of taking your delivery to the delivery premises and obtaining a signature.

The rules which the councils set out for the issuing of tickets aren’t the same as the rules which determine whether the ticket is valid or not.

You could have just driven off before they gave you the ticket. Unless you were in an area with CCTV parking enforcement they’d have had no comeback against you.

Red Route parking offences are now dealt with by Penalty Charge Notices, rather than Police Fixed Penalty Notices. PCNs have to be either handed to the driver or attached to the vehicle to be valid.

Dennis, remind me what happened. You’re allowed to stop on yellow lines anyway if you’re collecting or delivering – you don’t need the say so of a traffic warden. I’m guessing they were Parking Attendants rather than Traffic Wardens (big difference)? Was it just double yellow lines or were there loading restrictions as well (kerb ‘blips’ or stripes).

In some circumstances you’d just be wasting your time and money by carrying on, but in others you’d have a cast-iron case that you’d only win at the last possible stage.

It’s just a notice of charge issued on behalf of whatever shonky private company controls the car park at Oxford services.

I think they’ve got long-term and short-term parking at Oxford? If you park in the long term you’re meant to buy a pay and display ticket.

Send the solicitors a letter – “According to my records I could not have been at that location at that time. If you have evidence that I was and that I had agreed to this charge please send it to me and I will assess your claim. If you fail to do so I will assume that your claim is entirely spurious.”

Nobody’s going to jump through hoops, provide all the details requested within a reasonable time and take you small claims court 150 miles from where they’re based for the vague chance of gaining £80.

Actually parking tickets aren’t a tax deductable expense Simon. Even if they were do you think it’s any more palatable to know that by paying £60 to the council you’ve cut your tax bill by £15? Anyone invoicing their customers extra to cover a parking ticket should be aware that while their charge to the customer is taxable income, the parking ticket isn’t a deductable expense. So if you get a parking ticket for £60 and charge your customer £60 you’re deemed to have made an extra £60 taxable profit.

What’s even more bizarre is that if an employee is HANDED a ticket for a company owned vehicle and the company subsequently pays the ticket then the company has to include the parking ticket payment in the employee’s gross pay as taxable income subject to NI & PAYE. If the same ticket is attached to the vehicle then the company can pay it without accruing any further liability.
