Legal action for ‘passing off’

We’ve just been threatened with legal action by these people www.asapsameday.com because our website includes the phrase “QUICK RESPONSE COLLECTION AND ASAP SAME-DAY DELIVERY “.

I’ve decided to follow their example, so any of you with the word ‘Anywhere’ on your websites had better remove it straight away.

I’m just worried in case Quick Response Collection Ltd come after us as well, or Dedicated Sameday Service Ltd.

Joking aside, I’m more aware than most of the seriousness of ‘passing off’ and of copyright infringement, this blatantly isn’t either so I told him to fuck off and put the phone down on him.

I’ve just noticed they’ve not got their company details on their website either, so I’ll be letting Companies House and Trading Standards know about that.

They say that they’re “Warrington Cheshire’s leading Independent same day specialist”.

I wonder what sort of research they did before making that claim, or what the difference is between an Independent same day specialist and any other sort.
