Yes and Yes
It’s best used as a threat to extract a payment from someone – pay up within 7 days or the bill increases by £40. It works every time. Smaller companies are unlikely to use you again – larger organisations (Councils, NHS Trusts, Blue Chip companies etc) tend to just pay the Late Payment penalty and carry on using you.
You can go back SIX YEARS and apply the charge to all payments that were received late. The charges are treated as a normal debt and can be chased through the courts in the normal way if
